Terms and Conditions

General

www.airport-wien-taxi.com provides services based on the following Terms and Conditions, service descriptions, and price lists. Deviating terms and conditions do not apply, even if www.airport-wien-taxi.com does not expressly object to them. Deviations from these conditions require the express written acknowledgment of www.airport-wien-taxi.com. A contract is only concluded when confirmed by www.airport-wien-taxi.com.

Scope of Services

The scope of services is determined exclusively by the written order confirmation from www.airport-wien-taxi.com or alternatively by the written offer from www.airport-wien-taxi.com. Information contained in brochures, service catalogs, price lists, and similar information is only binding if expressly referenced. Transportation is carried out in accordance with road traffic regulations and passenger transport laws.

Passengers must follow the instructions of www.airport-wien-taxi.com or the chauffeur. If guests disregard instructions or pose a risk according to traffic regulations or by impairing the chauffeur's ability to drive safely, www.airport-wien-taxi.com is entitled to exclude them from transportation. In this case, www.airport-wien-taxi.com will charge the full fare including the fixed price or kilometer price and all additional services.

Airport Pickup (Airport Transfer)

Any change to the agreed pickup time, regardless of the reason, must be communicated to www.airport-wien-taxi.com immediately. Damages resulting from failure to provide immediate notification are the responsibility of the customer.

The waiting time for transportation from the airport is a maximum of 30 minutes. This is calculated from the time the aircraft lands. If you need more than 30 minutes from landing to reach the meeting point, you must inform us in time. Airport Vienna Taxi reserves the right to charge for waiting time from that point. If the customer does not agree with this, Airport Vienna Taxi reserves the right to cancel the trip and charge the full amount of the agreed price.

Prices

Prices include statutory VAT at the applicable rate. The prices valid on the day of booking confirmation apply. Package prices not listed in the price list can only be agreed upon in writing and are only valid for the agreed travel date and rental period.

Additional time and distances will be calculated according to the valid price list. Additional costs due to delays are the responsibility of the customer, unless the delays are due to the fault of www.airport-wien-taxi.com or the chauffeur. The fare includes the transportation of persons with normal luggage; the transport of bulky goods requires a separate agreement.

Payment Terms

www.airport-wien-taxi.com reserves the right to require a deposit of up to 50% of the total price before the start of the journey or to request a blank charge slip issued to www.airport-wien-taxi.com for a valid credit card before accepting an order. Remaining payments are due within the payment deadlines specified on the invoice.

For the timeliness of the payment, receipt of the amount for the unrestricted disposition of www.airport-wien-taxi.com is decisive. For payment by check, the claim is only considered paid after final complete credit. Payments are always used to settle the oldest claim.

If the customer is in default of payment, www.airport-wien-taxi.com charges interest at a rate of 5 percentage points above the base rate, subject to the assertion of further damages. For the second and each subsequent reminder, a €10 reminder fee is charged. The customer is free to prove a lesser damage.

Cancellations and Withdrawal

Cancellations are only effective if made in writing or if verbally confirmed in writing by www.airport-wien-taxi.com. For the timeliness of written cancellations, receipt by www.airport-wien-taxi.com is decisive.

Cancellations up to and including 1 hour before the contractually determined start of the journey are free of charge. For cancellations, www.airport-wien-taxi.com charges a portion of the basic fare as compensation. This portion is:

• Free for cancellations up to 1 hour before the start of service
• 50% for short-notice cancellations
• 100% for later cancellations and if the journey is not started

www.airport-wien-taxi.com charges expenses regardless of the timeliness of cancellations if they have already been incurred. The customer is expressly permitted to prove that www.airport-wien-taxi.com has suffered no or lesser damage.

www.airport-wien-taxi.com reserves the right to withdraw from the contract in whole or in part if the customer ceases payment, becomes insolvent, or if external circumstances suggest that the services are being improperly used, or if the customer violates any obligation under these contractual provisions.

Obligations and Liability of the Customer

The customer must immediately inform www.airport-wien-taxi.com of any change in name, (billing) address, legal form, and bank details. The customer is also obliged to provide the necessary information regarding passengers, time, and place of service. If the customer fails to provide prompt notification, they are liable for damages that could have been avoided with timely notification.

The customer undertakes, also on behalf of the passengers, not to misuse the service of www.airport-wien-taxi.com, in particular:

• Not to disrupt or hinder the fulfillment of the service
• Not to cause any damage
• Not to violate criminal laws
• To strictly adhere to the smoking ban in the vehicle
• Not to refuse to pay the fare

If a customer violates the aforementioned obligations, www.airport-wien-taxi.com is entitled to take all necessary measures to eliminate the misuse. In case of culpable violation, the customer is liable to www.airport-wien-taxi.com for damages.

Liability of Airport Vienna Taxi

www.airport-wien-taxi.com is liable to the customer for damages - regardless of the legal grounds - only in case of intent or gross negligence as well as culpable violation of essential contractual obligations of www.airport-wien-taxi.com, its legal representatives, or agents. Liability for injury to life, body, or health is governed by statutory provisions.

For property damage, the liability of www.airport-wien-taxi.com is limited to €1,000.00 per passenger. The vehicles have liability insurance according to the applicable General Insurance Conditions. The customer must arrange for any additional insurance themselves.

www.airport-wien-taxi.com is not liable for non-pickups, missed appointments, and their economic consequences.

www.airport-wien-taxi.com assumes no liability towards the customer or passenger for damages resulting from erroneous transmission of data by the customer.

Applicable Law and Jurisdiction

For all legal relationships between www.airport-wien-taxi.com and its customers, Austrian law applies exclusively. The place of jurisdiction and performance is Vienna.

Partial Invalidity

Should one or more of the above conditions be invalid, the remaining conditions remain unaffected by the invalidity. In place of invalid clauses, the statutory provisions apply.
